TERMS AND CONDITIONS
www.nekonekoparis.com (hereinafter referred to as “the Site””) is published by KALEIDO, SASU, a simplified joint stock company with a capital of 7.200 Euros, whose registered office is situated at 8, rue Sainte Isaure 75018 Paris France, registered with the Paris Trade and Companies Register under number 524 848 397, and whose Intra-Community VAT number is FR 75 524 848 397 (hereinafter referred to as “KALEIDO”). These general conditions of sale shall apply to all orders placed on the Site. KALEIDO reserves the right to adapt or modify these conditions. The applicable version of the general conditions of sale shall be the one that appears online on the Site at the time the order is placed.
I – Customers
The Customer declares that it is a physical or moral person and has the legal capacity to place an order on the Site.
The Customer must ensure that the mandatory personal details registered under the “my account” tab are correct and complete. KALEIDO will not be responsible for failure to deliver a product if the addressee’s details supplied are incorrect. KALEIDO shall be entitled to cancel an order if the Customer’s IP address is from a different country to the billing address and/or delivery address.
II – Goods
The items that are offered for sale are those described in the Site. KALEIDO takes every care to ensure that the display and description of these items are as informative as possible. However, the Customer acknowledges and accepts that the Site may contain minor errors. If a delivered item does not conform to its description on the Site, the Customer may cancel the order or may rely on the implied warranty that the item is fit for purpose and KALEIDO shall, as the case may be, either exchange the item or refund (all or part of) the price charged.
III – Orders
Orders placed on the Site shall comply with the procedure put in place by KALEIDO, which includes a series of steps which the Customer must follow in order to confirm an order. Before finally confirming an order, the Customer will have the opportunity to check the order details and the total price, and to correct any errors. A confirmed order shall constitute a sales contract and the acceptance of all the terms herein.
KALEIDO may refuse an order from a Customer with whom it is involved in legal action or is in dispute regarding the payment of a previous order, or which may breach the terms hereof.
If such a case arises, KALEIDO shall inform the Customer of the same by email. Unless the Customer contacts KALEIDO in order to correct details which are inaccurate or contrary to these general conditions of sale, KALEIDO reserves the right not to fulfill the order.
KALEIDO shall send the Customer an order summary setting out the items, prices, stock availability, quantities and so on. For this purpose, the Customer agrees that KALEIDO may send confirmation of the contents of an order to it by email. Invoices shall be remitted at the time of delivery.
In the event that some or all of the ordered items are out of stock, the Customer shall receive an email confirming either that the order shall be canceled or that it shall be partially fulfilled.
Pursuant to the provisions of article L 121-20-3 of the French Consumer Code, in the event that an ordered item is out of stock, the Customer may either:
– agree to the delivery of an item of equivalent quality and price from the range of available items;
– receive a refund of the price of the ordered item or service within 30 days of requesting a refund.
IV – Prices and payment methods
All prices are quoted in Euros and are inclusive of all taxes except for import duties. The total price of the order (including taxes and import duties) is indicated on the payment page.
The provisions of the French Tax Code relating to VAT shall apply to deliveries outside the French territory. Depending on local regulations, customs duties may be payable on delivery.
KALEIDO reserves the right to change its prices at any time. However, items shall be invoiced on the basis of the prices in force at the time the order was placed, subject to availability of stock.
2. Payment methods
Payment for goods is due on the date of the order.
Payment may be made by card or via PayPal. The cards which are currently accepted are: Carte Bleue, Visa and MasterCard.
The Customer warrants that they are entitled to use the payment card or their PayPal account to pay for the order.
PayPal: the total order amount shall be immediately debited from the PayPal account.
The order shall be considered effective upon confirmation of the banking payment centers’ agreement.
The Customer is advised to print out and retain their receipt in order to keep a record of the transaction details.
3. Recorded data
The data recorded and kept by KALEIDO constitutes proof of the order and of all transactions. The data recorded by the payment system constitutes proof of the financial transactions.
All personal information saved at the site will be handled with the most utmost care. The information that we store will not be sold or used for any purposes other than ensuring the best service possible. It will solely be used for informing you about special offers and other marketing opportunities related to the different divisions of KALEIDO Your personal data may be disclosed to third parties only when it is necessary to fulfill the purposes described above. If you wish to end your NEKO NEKO subscription, you may make the changes in your account settings or send an email to email@example.com. State your name and email address and a short description of the matter in the email message. You have the right to review your information on file at any time. This can be accessed by emailing firstname.lastname@example.org. If the data is incomplete or incorrect, you have the right to have the information corrected. All customers paying by card are subject to validation checks. KALEIDO reserves the right to delay any order if fraud is suspected. For security reasons, we do not store any payment information in our database.
V – Delivery
Delivery shall be made to the delivery address supplied by the Customer, which must be the residential address of the Customer or of any other physical or moral person selected by the Customer and domiciled in France (including the French Overseas Territories and Departments) or abroad. KALEIDO reserves the right to refuse certain orders sent from abroad for regulatory reasons or due to practical difficulties in delivering the merchandise. KALEIDO shall inform the Customer of such a refusal by email and shall refund the total payment received in respect of the relevant order within 5 days from the date of the email.
Delivery may not be made to PO boxes.
In order to ensure that delivery times are met, the Customer must ensure that the details it has supplied in respect of the delivery address are correct and complete (including: house or building number, floor numbers, access codes, names and/or telephone numbers, etc.).
The Customer may select one of the following delivery methods:
Standard Delivery by So Colissimo. Deliveries normally take 5 working days and are made between Monday and Friday, excluding public holidays. Deliveries must be signed for at the delivery address supplied at the time of the order. If no one is available to take delivery of an item, a calling card will be left advising the Customer that the parcel may be collected from the nearest post office. Parcels shall be kept for collection at the post office for 15 calendar days. In the event that a parcel is not collected within the time limit set by the carrier, the items shall be returned to KALEIDO, which will attempt to contact the Customer in order to agree a new delivery date, failing which it will refund the total order amount, including delivery charges, within 5 days from the date of receipt of the parcel returned by Colissimo.
Completed deliveries A delivery shall be deemed to have been completed once the items have been made available to the Customer, by the carrier, using the carrier’s control system such as the delivery tracking system offered on the website of the French post office (La Poste) with regards to “So Colissimo” for deliveries to France.
The Customer is responsible for checking the items on delivery and to raise any reasonable objections or complaints, and may even refuse to take delivery of an item, if the item appears to have been opened or is clearly damaged. Such objections and complaints should be addressed to the carrier by registered post with acknowledgment of receipt within three working days from delivery of the items and a copy shall immediately be sent to KALEIDO.
VI – Right to cancel
The Customer may cancel their order, for any reason, within fourteen (14) days from the date of delivery of the order, in which case the Customer must, at its own cost, return the items in new condition, and:
– the items must be properly protected, in their original packaging, in perfect resale condition (undamaged and clean) together with all accompanying accessories, and documentation,
– the items must be returned with the sales invoice in order to enable KALEIDO to identify the Customer (order number, name, first name and address).

KALEIDO shall refund to the Customer the amount paid, including second class postage costs, in accordance with paragraph VII below.
VII – Refunds
KALEIDO shall make the refunds referred to in paragraphs II and VI within 5 days following its receipt of the relevant items.
VIII – Data processing and protection
The data gathered by KALEIDO when an order is placed is needed in order to manage the transaction. All or part of this data may be circulated for this purpose to the service providers used by KALEIDO to carry out the order. The Customer is informed that this personal data may also be gathered by an organization tasked with analyzing orders and fighting payment card fraud. In accordance with the French law on data protection (loi Informatique et Libertés n°78-17 of 6 January 1978), the Customer has the right of access to personal data held on them, to demand its rectification or removal and to object to the processing of this data.

By placing an order on nekonekoparis.com, you certify that you are purchasing products for your own personal use and not for resale and that you accept our general terms and conditions. We reserve the right to refuse orders for any reason without explanation.
XII – Colors
We cannot guarantee that colors on the website will be true to life. This depends partly on the color settings of your computer and monitor.
XIII – Violation of rules
KALEIDO reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Individuals violating the restriction of password-protected areas of the site may be subject to prosecution.
Returns and Refunds
You have 14 days from receipt of our shipment to return, for whatever reason, all goods ordered on www.nekonekoparis.com.
